Resident sues Phu My Hung Corporation for shoddy construction

Real estate developer Phy My Hung Corporation has been sued by the owner of a high-end apartment for low construction quality and damage suffered.

The Saigon Tiep Thi newspaper reported Tuesday that Pham Thi Kim Anh has filed a lawsuit at the People's Court of District 7, Ho Chi Minh City, asking Phu My Hung Corporation to compensate for the low quality of her apartment at the high-end building Hung Vuong 2 at Phu My Hung Urban Zone.

Anh asked that the developer gives her a better apartment, VND400 million (US$19,200) in compensation, including the money she has spent renting another apartment since hers started to leak, and the medical fees for her husband, whose sickness doctors say was caused by the living environment in the apartment.

In her lawsuit, Anh said she bought the apartment in April 2009 for nearly VND4 billion. Two months later, the roof, which is located right under four bathrooms of two other apartments, started to leak.

She said the condition worsened in late July when water poured in heavily causing the house to stink. Green fungus also appeared on the ceiling and walls.

The developer sent people to fix the problem several times, saying that the leak was caused by bathrooms above, but the situation only got worse.

Anh said she had asked Phu My Hung Corporation to give her a different apartment, but the latter had refused.

In the letter sent to Anh denying her request, the developer said that the house had been occupied for eight years before Anh took it and the company's warranty had expired.

The company also referred to the contract in which Anh had agreed to "buy the house in its current condition."
