Advertising Odinance

Advertising Odinance No. 39/2001/PL-UBTV QH10 date 16/11/2001; Decree No. 24/2003/NĐ-CP date 13/03/2003 ; Circular letter 43/2003/TT-BVHTT date 16/07/2003).

The following advertising behaviours are strictly forbidden:

+ Advertisements have ethnic and racial discrimination, violation to the freedom    of belief and religion.
+ Advertisements have the contents of violence, thrills; unwholesome words.
+ Advertisements use images of leaders of Vietnamese Communist Party and    Government.
+ Advertising is untruth about quality of goods and services; incorrect    company’s address.

Stipulations of Government about advertising in Internet :

Products are fobbiden to advertise :
+ Over 15o alcohol concentration wine, tobacco.
+ Products are used to replace mother’s milk for the newborn and under 6 months old children, baby bottle and rubber nipple in any form.

Advertising products must have license or certificate that are certified by related Government agencies :

+ Medicine, raw material for producing medicine, cosmetics, vaccines, health equippments, health services and foods advertisements.

+ Biological products for farming, breeding, foodstuff for cattle, medicine for cattle, insecticide, fertilizer, manufactured article of fertilizer, vegetation variety, domestic animal variety.

+ All the information about protection status on the advertisement of invention, useful solution, industrial design, brands, origin of goods, geographic instruction, trademarks, copyright and all the rights concerned must be guaranteed correctness and follow the law of industrial ownership and copyright.

+ Organizations or individuals, producing or trading many industries, many kinds of goods which have the same brand name (ex : Company name), must show clearly the contents of advertised industry or the kind of advertised goods.
